 Here are eight common We-Swap.net scams that may occur and some tips to avoid falling for them.

1. Email or texting phishing scams. 

You may receive an email or text from a spoofed account that looks like it’s coming from We-Swap.net but is from a scammers. These messages may have a link to an outside source that encourages you to click. Once you do, it’ll ask you to log in, request a credit card payment or even verify your identity. But when you click on that link, it installs spyware on your computer or phone.

Usually, the con artist is scamming several people at once in the hopes that a few of them will click on the fraudulent link so they can steal your identity or take your information hostage through spyware

The swapper will send you what appears to be a genuine personal check.

Sometimes, con artists can be incredibly convincing with a story about the death of a relative or recent injury that prevents them from meeting you in person. 

They could even tell you they were recently deployed to the national guard or military, or that they’re in the middle of a recent move.

If the swapper refuses to meet you, you should consider it a potential scam and move on from trying to swap the item.

 5. The verification code of scam:

Sometimes a scammer can flip the script and say that they need you to verify that you’re not a scammer

A con artist sends you a message asking you to verify your phone number, so they know you’re a real person and not a bot. The scammer can then use this code to verify your phone number or email address on an account somewhere else, potentially implicating you, since they’re using your information.

Never send a verification code to someone. If they’re trying this scam on you, you should immediately report and block the account.

 6. No Escrow fund:

This type of We-Swap.net scam is typically associated with expensive items, like Electronics, Shoes, Clothes or Jewelry. We at We-Swap.net does not provide escrow account to any swapper. While escrow may seem like a great idea when Swapping an expensive item from We-Swap.net. While legitimate, escrow accounts work as the middleman between a swapper and buyer. The escrow service pays the swapper when the buyer has received the order. But at We-Swap.net, we do not provide this service.

 When it’s used as a scam, a swapper says they have their own trusted escrow company that they want to go through. The company may even have a website. However, this is often the swapper posing as an escrow service. 

Be wary if a swapper insists on using a specific escrow service, especially if it’s an international service.

As a new Swapper who wants to swap your items on We-Swap.net with confidence.

If you do, and you’re worried about the stories you’ve heard regarding fake electronics, bad buyers and shady people. In honor of the disclaimer We-Swap.net attaches to every mail that comes in, we decided to create a more exhaustive list of rules to follow when Swapping there. Using these rules as a guide, you’ll be more comfortable in the jungle that is We-Swap.net.

Briefly: With this list of Dos and Don’ts for the We-Swap.net swapper, you’ll be able to swap online with more confidence.

 Don’t swap without doing research – The single most valuable thing you can do before Swapping your items on We-Swap.net, is research. Before you set an ad, search your local We-Swap.net and find similar items to get an idea of the average market item. Don’t ship or use paypal/credit card/electronic for payments – Increasingly related to the scams you’ll come across, never offer to ship items. Swap everything locally for Cash.

Don’t get your hopes up  – If a swap is imminent and there are allot of back and forth messages or texts – don’t pin the swap on this person. Be willing to walk away at any point if this person offers something unreasonable. Don’t ever compromise on items you’re swap for because of a story provided by a swapper.

 Common stories are having to pay for fixing an item, needing to pay for travel, a friend who says something that should make you sell cheaper. Many will want something for nothing, so be wary of this and don’t get your hopes up.

Don’t post if you aren’t ready to swap now – I have encountered many swappers who seem not capable of Swapping an item right away. When you post the item on We-Swap.net, it should be ready to swap now, and you should be capable of meeting right away. This means you should have the item cleared of data, the packaging and item in the same location and the ability to meet quickly. If you are just planning to test the waters with interest in an item, I would suggest that you post it, but not reply to any of the eventual queries that come in.

 Don’t post without pictures – For your ad to to be exposed to the most possible people, never post it without a picture. You will never swap a physical item and not be able to take pictures of it. A general rule it to post at least three pictures: One of the main item itself, one of the packaging and one with all of the items (with extras) that you intend to include with your swap. Pictures will help you swap your item(s) much faster and be noticed by more swappers. Also, don’t ever use “Stock” photos off the Internet – take pictures of the actualitem.

 Do renew ad at the right time – If the ad you’ve posted on We-Swap.net is still online for more than 5-7 days, We-Swap.net offers you a way to “Renew” it and place it back at the top of your local listings for a fee of £1.99. Be smart about when you do this: Don’t renew late at night, do it when most people are looking at We-Swap.net in the morning or afternoon.  You agree not to use We-Swap.net or the API in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.

 LIQUIDATED DAMAGES.

You further agree that if you violate the TOU, or you encourage, support, benefit from, or induce others to do so, you will be jointly and severally liable to us for liquidated damages as follows for:

 (A) Collecting/harvesting We-Swap.net users' information, including personal or identifying information - $1.00 or £1.00 per violation;

(B) Publishing/misusing personal or identifying information of a third party in connection with your use of We-Swap.net without that party's express written consent - $500 or £500 per violation;

(C)  Misrepresenting your identity or affiliation to anyone in connection with your use of We-Swap.net - $500 or £500 per violation;

(D) Posting or attempting to post Prohibited Content - $4 or £4 per violation;

(E) Posting or attempting to post Prohibited Content in any paid section of We-Swap.net - the price per post applicable to that section of We-Swap.net;

(F) Sending an unauthorized/unsolicited email to an email address obtained from We-Swap.net - $25 or £25 per violation;

(G) Using We-Swap.net user information to make/send an unauthorized/unsolicited text message, call, or communication to a We-Swap.net user - text/call/communication;

(H) Creating a misleading or unlawful We-Swap.net account or Swapping a We-Swap.net account - $4 or £4 per violation;

(I) Abusing or attempting to abuse We-Swap.net's flagging or reporting processes - $1 or £1 per violation;

(J) Distributing any software to facilitate violations of the USE Section - $500 or £500 per violation;

(K) Aggregating, displaying, framing, copying, duplicating, reproducing, making derivative works from, distributing, licensing, Swapping, or exploiting We-Swap.net content for any purpose without our express written consent - $100 or £100 for each day you engage in such violations;

(L) Requesting, viewing, or accessing more than 1,000 pages of We-Swap.net in any 24-hour period will result in a- $0.25 per page during the 24 hour period after the first 1,000 pages;

(M) Bypassing or attempting to bypass our moderation efforts - $4 or £4 per violation. You agree that these amounts are: 

(1) A reasonable estimate of our damages (as actual damages are often difficult to calculate),

(2) Not a penalty, and; 

(3) Not otherwise limiting on our ability to recover under any legal theory or claim, including statutory damages and other equitable relief (e.g., for spam, we can elect between the above liquidated damages or statutory damages under the anti-spam statute). You further agree that repeated violations of the USE section will irreparably harm and entitle us to injunctive or equitable relief, in addition to monetary damages.

 FEES.

When you make a paid posting (We-Swap.net), you authorize us to charge your account. Any tax is additional. Fees are non-refundable, even for posts we remove, delay, omit, re-categorize, re-rank, or otherwise moderate. We may refuse any posting.

DISCLAIMER & LIABILITY.

To the full extent permitted by law, We-Swap.net, Inc., and its officers, directors, employees, agents, licensors, affiliates, and successors in interest ("We-Swap.net Entities")

(1) make no promises, warranties, or representations as to We-Swap.net, including its completeness, accuracy, availability, timeliness, propriety, security or reliability;

(2) provide We-Swap.net on an "AS IS" and "AS AVAILABLE" basis and any risk of using We-Swap.net is assumed by you;

(3) disclaim all warranties, express or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement, and all warranties arising from course of dealing, usage, or trade practice; and

(4) disclaim any liability or responsibility for acts, omissions, or conduct of you or any party in connection with We-Swap.net. Any claim, cause of action, demand, or dispute arising from or related to We-Swap.net ("Claims") will be governed by the internal laws of California, without regard to conflict of law provisions, except to the extent governed by US federal law. Any Claims will be exclusively resolved by courts if you in San Francisco, CA (except we may seek preliminary or injunctive relief anywhere).

(1) submit to the personal jurisdiction of courts if you live in San Francisco, CA;

(2) indemnify and hold We-Swap.net Entities harmless from any Claims, losses, liability, or expenses (including attorneys' fees) that arise from a third party and relate to your use of We-Swap.net; and;

(3) be liable and responsible for any Claims we may have against your officers, directors, employees, agents, affiliates, or any other party, directly or indirectly, paid, directed or controlled by you, or acting for your benefit.

 TRADEMARKS.

We-Swap.net, "We-Swap.net" and the peace symbol logo are registered trademarks with the U.S. Patent and Trademark Office and with multiple trademark offices around the world.

MISC. Unless you have entered into a separate written or electronic agreement with us that expressly references the TOU, this is the exclusive and entire agreement between us and you, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. Users complying with prior written licenses may access We-Swap.net thereby until authorization is terminated. Our actions or silence toward you or anyone else does not waive, modify, or limit the TOU or our ability to enforce it.
